1. Tracking and attribution
Attribution starts when a visitor opens a premium partner's link or QR for the first time and runs for 90 days, on every device the visitor uses. No personally identifiable information is stored as part of the tracking. Last scan wins. If the visitor opens another premium partner's link or QR inside the 90-day window, attribution moves to that new partner and the 90-day clock restarts from the new scan; the previous partner stops earning on that visitor going forward. SurfBooking is the sole arbiter of attribution data; premium partners may dispute via [email protected] within 30 days of the relevant statement.
2. Commission base and adjustments
Your reward is a share of each attributed booking, agreed with you when you join. It accrues on the date Stripe confirms payment and matures into a payable balance 30 days after the booking's lesson date — long enough to cover the standard refund window and the bulk of chargeback risk. After maturity, the balance is included in the next month-end payout cycle. Refunds, chargebacks, fraudulent bookings, no-shows that get refunded, and any booking that doesn't generate platform fee revenue produce zero (or, if already accrued, reverse) commission. Late chargebacks (Stripe permits up to 120 days) that hit after maturity are deducted from the next payout or, if the balance is zero, invoiced back to the premium partner.
3. Payout, invoicing, taxes
- Monthly cycle, settled within the first 10 working days of the following month, after the premium partner issues a valid invoice / recibo verde.
- Minimum payout €25 — balances below carry forward.
- Methods: SEPA, Wise or PayPal.
- PT individuals under Cat B with the withholding flag enabled: 25% IRS withheld at source per Art. 101 CIRS unless a reduced regime applies. Companies (NIPC) and non-PT partners: no PT withholding (you handle local taxes).
- EU VAT under reverse-charge (Art. 196 VAT Directive) where applicable. PT VAT-exempt under Art. 53 CIVA where the premium partner qualifies.
- DAC7 (Decreto-Lei 73/2023, EU 2021/514): SurfBooking must report partner earnings exceeding 30 transactions OR €2,000/year to the Portuguese tax authority. Partners receive a copy of the filed data before the annual deadline.
4. Brand, trademark and content licence
SurfBooking ® is a Portuguese registered trademark (INPI nº 9628785). For the duration of your active participation in the program, SurfBooking grants you a non-exclusive, non-transferable, revocable licence to use the SurfBooking name, logo and the brand assets we provide (including embeddable widgets) strictly to promote SurfBooking on your own properties (website, IG/TikTok/YouTube channels, email signature, printed materials at your venue). Modifying the logo, combining it with offensive content, implying official partnership beyond what the program grants, or using it after termination is prohibited.
5. Forbidden practices (zero tolerance)
- Brand bidding: bidding on SurfBooking, surfbooking.eu, or close-variant trademarks on Google Ads, Meta Ads, Bing Ads or any paid-search/social channel — including misspellings and dynamic keyword insertion that could trigger such matches.
- Impersonation: registering domains, social handles, app store apps or email aliases that suggest you are SurfBooking or speak on its behalf.
- Spam: unsolicited bulk email, SMS, WhatsApp blasts, comment spam, deceptive push notifications. Anything that violates RGPD/PECR/CAN-SPAM/local equivalents.
- Cookie stuffing / click fraud: any artificial inflation of clicks or attributions — auto-redirects, hidden iframes, paid bots, incentivised clicks. Detected fraud forfeits all related commission and may result in immediate termination.
- Self-referrals: using your own link to book your own lessons, or coordinating with friends/family to do so.
- Pressuring schools: for premium partners on the ground — using the SurfBooking name to coerce schools into signing or to extract favours outside the platform.
- Misrepresenting offers: publishing prices, availability or claims about SurfBooking that aren't current and accurate on the platform.
Confirmed breaches: SurfBooking may withhold accrued commission, terminate the premium partner immediately, claw back paid amounts proportionally to the fraud, and pursue legal remedies. SurfBooking's determination is final, subject to good-faith review on the premium partner's written request within 30 days.
6. Country managers — additional duties
Partners that physically sign up schools assume an additional duty of care: only submit schools that meet SurfBooking's compliance bar (valid licence, insurance, certified instructors). Submissions go through admin review; knowingly false data is grounds for termination and clawback. Country managers are not agents of SurfBooking and have no power to bind SurfBooking with a school — pricing and contractual terms are negotiated directly between SurfBooking and the school.
7. Duration, withdrawal and termination
No perpetual contracts. No relationship under the Partners program is perpetual or guarantees lifetime entitlement. Each premium partner type has its own initial duration and renewal/withdrawal rules:
- Country managers: initial term of 24 months, tacitly renewable for 12-month periods unless either party gives 30 days' written notice. The longer term reflects the field-acquisition investment required.
- Influencers, media, agencies and ad-hoc partners: at-will, no minimum term — either party may terminate at any time by written notice.
No obligation beyond earned commission. Save for commission due on confirmed and matured bookings (Section 2), neither party owes the other any retainer, prolonged exclusivity or further compensation for acquisition or promotion work. The parties do not create an employment, agency, mandate or partnership relationship.
Withdrawal by either party. Either party may withdraw the relationship at any time by written email notice. Commission already accrued matures under Section 2 and is paid in the next cycle; commission not yet accrued (bookings after the termination effective date) lapses.
Immediate termination by SurfBooking (without prior notice and with forfeiture of pending commission) for:
- confirmed fraud, unauthorised brand use, or exfiltration/sale of school or student data
- conduct endangering students, schools, or the integrity of the marketplace
- repeated breach of these terms
- prolonged inactivity (>12 months with zero attributed clicks)
- damage to SurfBooking's brand image — publications, public statements, conduct in representation of the program, or visible behaviour that harms the brand's reputation
- using your position or partnership for self-interest beyond SurfBooking's purposes — diverting leads to competitors, conditioning schools to side payments, using the role for unrelated commercial purposes, or any undisclosed conflict of interest
Right to update rules and terms. SurfBooking reserves the right to update the program rules and these terms with the notice described in Section 11. Operational, anti-fraud and clarifying updates that do not materially adverse the premium partner may take effect immediately.
Surviving obligations: refund/chargeback adjustments (Section 2), tax obligations (Section 3), brand licence revocation (Section 4), confidentiality and intellectual-property duties.
8. Limitation of liability
To the maximum extent permitted by law, SurfBooking's total liability to any premium partner for all claims arising under or related to the program is capped at the total commission paid to that premium partner in the 12 months preceding the event giving rise to the claim, mirroring the cap in our Terms of Service. SurfBooking is not liable for indirect, consequential, lost-profit or reputational damages.
9. Governing law and disputes
These program terms are governed by Portuguese law. Disputes are first addressed by direct contact at [email protected]; failing resolution, the competent forum is the courts of the Comarca de Lisboa, without prejudice to mandatory consumer protections.
10. EU availability and DSA
SurfBooking is live in 175 countries — including all 27 EU member states (DSA trader status confirmed 2026-05-08). Partners may apply from any country and commission is paid in EUR via Wise Bulk Pay (or Stripe Connect for partners with an existing account).
11. Changes to the program
SurfBooking may update these terms with at least 30 days' written notice by email. Material adverse changes (e.g., commission % cuts) take effect only on bookings made after the notice period; commission already accrued is settled under the prior terms. Continued participation after the effective date constitutes acceptance.
